Terms of Service — EVERBELL LLC (DBA 3L Candle Studio)

Effective date: January 1, 2025

These Terms are a legal agreement between you and EVERBELL LLC d/b/a 3L Candle Studio (“3L Candle Studio,” “we,” “us,” or “our”) governing your use of our website and your purchases from us.

1) Eligibility & Accounts

You must be at least 18 to purchase. Keep your account credentials confidential; you are responsible for activity under your account.

2) Product Information

We aim for accurate product descriptions, but minor natural variations—e.g., light frosting, “wet spots,” slight color swirl, micro-bubbles, or label alignment within ±1.5 mm—can occur and are not defects.

3) Orders, Pricing, and Taxes

Your order is an offer to buy; we may accept or decline it. Prices, promotions, and availability can change without notice. Sales tax, shipping, and fees are calculated at checkout.

4) Payment & Fraud

Payments are processed by our third-party processor. We may refuse/limit any order or require additional verification to prevent fraud or misuse.

5) Shipping, Risk of Loss, and Delivery Issues

Risk of loss and title pass to you when we deliver goods to the carrier. If a package is marked delivered but missing, notify us within 7 days; we’ll help investigate and may reship once after a signed non-receipt statement. If no ship time is stated, we ship within a reasonable time; if delays occur, we’ll either seek your consent to delay or promptly refund.

6) Returns, Exchanges, and Refunds

Our Return & Refund Policy is incorporated by reference and governs all returns, exchanges, Scent Swap eligibility, and defect handling.

7) Candle Safety & Proper Use

Follow the safety card: burn on a level, heat-resistant surface; keep away from drafts; trim wick to ~¼″ before each use; burn 2–3 hours per session; never leave unattended; keep out of reach of children/pets. Misuse may void eligibility under the Return & Refund Policy.

8) SMS/MMS Messaging Program

By calling or texting our number—or submitting your number with consent—you agree to receive service-related texts (e.g., 3L Service Updates, order updates, pickup reminders). Message frequency varies. Msg & data rates may apply. Reply STOP to cancel; HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. 9) Promotions, Gift Cards, and Store Credit

Promo codes may not be combined and have stated expirations. Gift cards and store credit are non-refundable and not redeemable for cash unless required by law.

10) Intellectual Property

Site content (text, images, logos, designs) is owned by us or our licensors. You may not copy, distribute, modify, or use our content except as allowed by law or with permission.

11) User Content & Acceptable Use

If you submit content (e.g., reviews, photos), you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and promote our services. Do not post unlawful, infringing, or harmful content; do not interfere with site security; do not attempt to access data not intended for you.

12) Third-Party Services

We use third-party providers (hosting, payments, messaging, analytics, shipping). Their terms and privacy practices apply to their services.

13) Disclaimers

EXCEPT AS EXPRESSLY STATED, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

15) Indemnity

You agree to defend, indemnify, and hold us harmless from claims arising out of your misuse of the site/products or violation of these Terms.

16) Governing Law; Venue

These Terms are governed by the laws of the State of Florida (without regard to conflict-of-laws rules). Exclusive venue lies in the state or federal courts located in Florida, and you consent to personal jurisdiction there. (If you want binding arbitration and a class-action waiver, I’ll add a compliant clause.)

17) Changes to Terms

We may update these Terms by posting a revised version with a new effective date. Your continued use constitutes acceptance.
